1. Acceptance of Terms
Welcome to SoulDate. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Softhuge Technologies Private Limited ("Softhuge Technologies Private Limited", "we", "us", or "our"), governing your access to and use of the SoulDate mobile application, website, and related digital services (the "Service").
By downloading, installing, registering with, or using SoulDate, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.
2. Eligibility & Account Verification
- Strict 18+ Age Requirement: You must be at least 18 years of age to register or use SoulDate. Creating an account on behalf of a minor is strictly prohibited.
- Single Account Policy: Each user is permitted only one active account. You may not create duplicate, automated, or bot accounts.
- Authentic Identity: You must provide truthful, accurate, and current information. You may not impersonate any other person or use photos that do not depict you.
- Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and mobile device access.
3. Community Rules & Prohibited Conduct
SoulDate is built on mutual respect, kindness, and authentic connections. You agree not to engage in any of the following prohibited activities:
- Harassment & Hate Speech: Bullying, intimidation, defamation, stalking, hate speech, racism, sexism, or discrimination against any individual or group.
- Explicit & Inappropriate Media: Posting pornography, nudity, sexually explicit content, graphic violence, or non-consensual sexual imagery.
- Commercial Solicitation & Prostitution: Soliciting commercial sex work, escort services, financial aid, loans, multi-level marketing, or unauthorized advertising.
- Fraud & Scams: Attempting to defraud users, requesting money or crypto transfers, phishing, or sharing deceptive links.
- Platform Abuse: Reverse engineering, decompiling, scraping, or deploying automated bots or spiders on SoulDate systems.
Violation of any community rule will result in immediate profile suspension, permanent device-level ban, and potential referral to law enforcement.
4. Virtual Goods, Purchases & Subscriptions
- Authorized Payment Gateways: All digital purchases, including premium subscription tiers, Spotlight boosts, virtual gifts, and coin packages, are processed securely via authorized platforms and certified payment processors (such as Google Play Billing, Apple App Store, Razorpay, Stripe, and other supported regional payment gateways).
- Non-Transferable License: Digital items and virtual currencies purchased within SoulDate represent a limited, non-exclusive, revocable, and non-transferable license for in-app utility only. Virtual items have no monetary value outside SoulDate and cannot be redeemed for fiat currency.
- Subscription Renewals & Cancellations: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing cycle through your respective payment provider (Google Play account, Apple ID, or direct payment subscription management portal).
- Refunds: Digital purchases are governed by our Refund Policy and applicable payment processor guidelines.
5. User-Generated Content & Intellectual Property
- Ownership: You retain ownership of the photos, text, and media you upload to SoulDate.
- License to SoulDate: By uploading content, you grant Softhuge Technologies Private Limited a worldwide, royalty-free, non-exclusive license to host, store, display, adapt, and distribute your profile content solely for the purpose of operating, developing, and promoting the Service.
- Content Responsibility: You represent and warrant that you own or have obtained all necessary rights, licenses, and consents for all content you submit.
6. Safety & Reporting Mechanisms
- In-App Reporting: SoulDate provides built-in tools enabling users to block and report profiles, offensive messages, or suspicious activity 24/7.
- Moderation Action: Our Trust & Safety team reviews reported accounts and takes swift corrective actions, including content takedown and account termination.
7. Disclaimers & Limitation of Liability
- Service Provided "As-Is": SoulDate is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied.
- User Interactions: Softhuge Technologies Private Limited does not conduct criminal background checks on all users. You are solely responsible for exercising caution and following safe dating practices when interacting with matches online or in real life.
- Limitation of Liability: To the maximum extent permitted by applicable law, Softhuge Technologies Private Limited shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the Service.
8. Governing Law & Dispute Resolution
- Jurisdiction (India): These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute or claim arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Haryana, India.
- Grievance Redressal: In compliance with Indian intermediary regulations, users may escalate complaints to our Grievance Officer at support@softhuge.com.
